General terms and conditions
of Reißzeugfabrik Seelig GmbH & Co. KG
1 Scope
1.1 The following general terms and conditions apply exclusively to all deliveries and other services. If the customer is a merchant, these terms and conditions shall also apply to all future business dealings, even if they are not expressly agreed to again.
1.2 If we not expressly accept the deviating terms and conditions of a customer who is a merchant, these terms shall not be deemed a component of the contract, even if we do not expressly reject them.
1.3 We ship to countries according to our country list.
The current list of countries can be found here.
2 Conclusion of contract
The offers in our online shop constitute a non-binding invitation to the customer to order goods. By clicking the button to complete the ordering process, the customer submits a legally binding offer to conclude a contract. The customer then receives an automatically generated e-mail, which is our binding confirmation of the contract.
3 Right to cancel a customer order
Due to the Corona pandemic or short-term changes in trade restrictions, it may be the case that the delivery of an order to a country outside of Germany or to a certain region of a country becomes impossible at short notice. In this case we reserve the right to cancel the contract for the customer's order in whole or in part. The customer will be informed immediately by e-mail and will of course receive a full refund of the payment made for the cancelled order or the cancelled part of the order.
Information on possible corona-related restrictions on the shipment of goods can be found at https://www.deutschepost.de/en/c/coronavirus.html#international.
4 Storage of the contractual provisions
The text of the contract and the general terms and conditions will be sent to the customer by e-mail with the confirmation of acceptance. The customer thus has the opportunity to access the contractual provisions, including the general terms and conditions, and to save them in a reproducible form. We will not make the text of the contract accessible beyond this. If the customer has set up a user account in our online shop, the order data will be archived on our website and can be accessed by the customer at any time free of charge by logging into their user account.
5 Right of withdrawal
Consumers are entitled to the statutory right of withdrawal. We provide more detailed information on this on our homepage under the heading “Right of withdrawal”.
6 Minimum order value; no delivery to packing stations
6.1 We only deliver orders above a minimum order value of € 29.00
6.2 We do not deliver to packing stations.
7 Prices, shipping costs, payment
7.1 The prices quoted for the products we offer include the statutory value added tax and other price components. In the case of a cross-border delivery, additional costs (such as exchange rate differences), taxes and/or duties (e.g. customs duties) may be incurred in individual cases that are beyond our control, that we are not aware of, and that are to be paid by the customer to the competent authority (e.g. payment service provider, tax or customs authorities). The customer is responsible for finding out about these costs themselves.
7.2 In addition to the indicated product prices there are shipping costs, which we calculate as follows:
a) Delivery within Germany:
Flat rate shipping costs: € 5.90 per order
b) Delivery within the European Union depending on the weight of the shipment:
up to 1 kg: € 9.90
up to 2 kg: € 13.90
from 2 kg: € 15.90
c) Delivery to the following countries depending on the weight of the shipment: Australia, Brazil, Lord-Howe Island, New Zealand, New Zealand Outer Territories, Puerto Rico, South Africa, Tasmania, Thailand, United States of America:
up to 2 kg: € 53.20
from 2 kg: € 64.00
d) Delivery to other than previously mentioned countries depending on the weight of the shipment:
up to 1 kg: € 9.90
up to 2 kg: € 19.90
from 2 kg: € 31.90
The shipping costs incurred for the products requested by the customer are displayed to the customer when they add the products they wish to order to the shopping cart, specifying the recipient address, without obligation and without having to place the order.
7.3 The payment of the purchase price is made via PayPal or by credit card (Visa, Mastercard).
8 Offsetting; retention of title
8.1 The customer shall only be entitled to a right of offset if the counterclaims have been legally established as final and absolute or if they are uncontested or have been acknowledged by us in written form.
8.2 The delivered products shall remain our property until full payment has been made.
8.3 If the customer is a merchant, they hereby assign to us in full as a security all claims that they acquire against their customer from a resale of the goods. The customer is authorized to collect these claims until such authorization is revoked. They will only revoke the authorization to collect and only collect the assigned claims themselves, if the customer does not properly fulfill their payment obligations to us.
9 Delivery times
Unless expressly stated otherwise for the products, we usually hand over the ordered products to the shipping service provider within three business days after receiving the order at the latest. The delivery time within Germany is thus usually five to seven business days. For deliveries to countries outside of Germany, the delivery time depends on the respective local shipping service provider responsible.
10 Warranty
10.1 The statutory warranty applies. However, if the customer is a merchant, the warranty period is limited to twelve months.
10.2 If a commercial transaction exists for both parties, the customer must examine the goods immediately upon receipt, insofar as this is feasible in the normal course of business, and if a defect is found, they must notify us of this within a period of one week. Timely dispatch of the notification of defects shall be considered to meet this deadline. If the customer fails to give this notification, the goods shall be deemed to have been approved, unless it is a defect that could not be detected during the examination.
11 Partial invalidity
Should any provision of these general terms and conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provisions shall be replaced by the statutory provisions.
12 Place of jurisdiction, applicable law
12.1 If the customer is a merchant, our registered office is the place of jurisdiction.
12.2 The contract is subject to German law, with exclusion of the application of the UN‑Convention on Contracts for the International Sale of Goods. This does not apply if the customer is a consumer, does not have their habitual residence within the scope of application of German law and the application of German law would deviate to their disadvantage from the mandatory consumer protection regulations in their country of residence.
13 Alternative dispute resolution
The EU Commission maintains a platform for the resolution of online disputes at https://ec.europa.eu/consumers/odr.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
